Officer Involved Shooting in Midland; Suspect in Serious Condition

MIDLAND -- Police were received a call about a home burglary with the use of weapons.
MIDLAND -- Police were received a call about a home burglary with the use of weapons.

According to city officials, when police arrived at the home, the three suspects had fled the scene.

Police say the three suspects began shooting towards a home and continued to shoot while forcing their way in.

One of the three suspects was armed with a handgun and the witness inside the home fought over the gun with the suspect.

The suspects include Hector Subia, Joshua Wallace and Joseph Gentry.

Subia was later found in an alley and pointed the gun towards himself before pointing at the officer.

"As soon as he pointed the gun at the officer, the officer did feel that he was able to use force," said Sara Higgins, public information officer for the City of Midland.

City officials tell us the officer fire two shots at Subio leaving him with life threatening injuries.

He remains in critical condition.

Suspects Wallace and Gentry were soon found later.

All three suspects will be facing charges of burglary with intent to commit another felony while Subio faces an additional charge of aggravated assault of a peace officer.

The Texas Rangers are now investigating the case to ensure the officer correctly used "use of force."
